Real Estate Terms & Conditions: Immediately following Auctioneer’s statement that property is sold, the successful bidder will enter into a binding contractual agreement with owner. Buyer will provide 10% of the purchase price as non-refundable earnest money to be deposited with Preferred Title of St. Joseph. The closing will be held on or before July 12, 2022 with certified funds at Preferred Title of St. Joseph. Seller agrees to provide clear title to property. Cost to close title transaction will be divided equally between Buyer and Seller. 2022 Real Estate Taxes will be pro-rated as of closing date. Buyer will take possession of property at time of closing. Property is subject to Probate Court Approval as such: Any contract executed following the auction sale will be subject to the approval of the proposed sale by the Probate Division of the Circuit Court of Buchanan County, Missouri in the Estate of Larry W. Myers. To obtain said approval Seller must promptly file with the Court a Report of Sale reporting that Seller proposes to sell the property to the Buyer named in the Contract under all of the terms set out in the within Contract, and seeking Court approval for such sale. The Report of Sale cannot be acted upon by the Court for a period of ten (10) days after it is filed. After the ten-day period, the Court is expected to enter an order approving the Report of Sale and authorizing and directing Seller to execute a personal representative’s deed on accordance with the terms of the within Contract.
